No Good News on Menu Pet Food Settlement

A week does not go by when I am asked if the Menu Pet Food Settlement will ever settle. I am sorry to report I have no idea when this nightmare of a lawsuit will ever be disbursed.

My email to the Claims Administrator shared the many stories I hear from pet owners regarding this lawsuit; to my dismay, the human side of this settlment was not addressed in their response.  The following is the response I just received from the Claims Administrator of the Menu Foods Pet Food Settlement…

Dear Susan Thixton,

The following message has been responded to:

————————————————————————

This is in response to your e-mail pertaining to the Pet Food Products Liability Settlement.

The status of the Settlement is as follows:
On November 18, 2008, after a full-day Final Approval Hearing, Judge Hillman issued an Order and 65-page Opinion approving the Settlement and denying all objections to the Settlement. These documents can be accessed at the webiste www.petfoodsettlement.com under “Important Links” . Appeals have since been filed by two separate objectors contesting final approval of the Settlement, and these appeals will postpone the payment of claims. No payments may be made on eligible claims until all appeals are resolved. THE APPEALS HAVE BEEN FULLY BRIEFED, A HEARING WAS HELD ON FEBRUARY 22, 2010 AND WE NOW AWAIT THE DECISION OF THE APPELLATE COURT. It is uncertain how long these appeals will take to resolve, and the timing of resolving the appeals is not within the control of the parties or their counsel. It is not uncommon for appeals to take several months or even years to resolve.

Sincerely,
